Resolution Calling to Defend the Michigan National Guard
WHEREAS, Article 1, Section 8 of the Constitution of the United States vests in the United States Congress the exclusive power of war but the Executive Branch has assumed this power without authority; and,
WHEREAS, The Tenth (10th) Amendment of the United States Constitution states: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people"; and
WHEREAS, when such unconstitutional actions are taken by the Federal Government, the proper role of the States is to remedy such situations, as outlined in the Kentucky and Virginia Resolutions of 1798; and
WHEREAS, The National Guard is under jurisdiction of States unless during time of Declared War, natural or manufactured disaster, therefore the consent of the Governor and the State Legislature is necessary to put the National Guard in a war zone; and
NOW THEREFORE BE IT RESOLVED, that as done previously by the Issues Sub-Committee of the Michigan Republican Party State Committee, the Michigan Republican 11th Congressional District Executive Committee calls upon the Michigan Legislature and Governor to enact legislation to “Defend the Guard” to prohibit the Michigan National Guard from being called into active-duty in a foreign war zone unless the U.S. Congress has declared war pursuant to Article 1, Section 8, Clause 15 of the U.S. Constitution, and
NOW BE IT FURTHER RESOLVED, that we bring home our Michigan Guard troops already deployed to foreign conflicts immediately, that the Governor and Legislature of Michigan shall not mobilize Michigan National Guard personnel to foreign service under Title 10 orders without an official Declaration of War from the United States Congress and that the Michigan Republican State Committee forthwith approve the ‘Defend the Guard’ resolution passed by the Issues Sub-committee, and
BE IT FURTHER RESOLVED, that upon adoption of this Resolution it shall be promptly distributed by the Committee’s Secretary to each member of Michigan’s Legislature, Governor Gretchen Whitmer, and the Adjutant General of the Michigan National Guard, and with copies sent to print, broadcast and social media in the State of Michigan.
As adopted by the Michigan 11th Congressional District Republican Executive Committee meeting in Bloomfield Hills, Michigan on October 15, 2024 with a vote of 18 - 0.
